Access to and use of the services of Peru Agency (“Peru Agency” and/or “our”) and our website is subject to acceptance of these terms and conditions (“Travellers Terms & Conditions”). By accessing, using or obtaining any content, or services through our offices or through our website, you, the purchaser and/or traveller (“Customer” and “passenger” and “you/your”) agree to be bound by these terms.
PLEASE READ THE TRAVELLERS TERMS & CONDITIONS BEFORE USING OUR WEBSITE. These terms & conditions govern the relationship between Peru Agency and you, the Customer. These terms restrict your rights and remedies and provide protection to Peru Agency. These also include warranty disclaimers and liability exclusions. By using this website you acknowledge and agree this is a fair balance because this website is accessible by you conveniently and at no charge to access the website.
Rates
OUR RATES are quoted in American Dollars (US$) and are subject to change without notice. They are per person based on a double room with a minimum of 2 people when a service is a group or shared service. Don’t forget to check any extra charges if you are a single traveller. Our rates include charges for payment by credit card.
Itinerary
The itineraries are carefully planned, however, changes to the order of activities or specified route may be necessary for operational reasons, climatic conditions, political situation, or any other eventuality. These cases are rare.
Services not included
The passenger is responsible for all administrative processes such as: obtaining or renewing passports, visas, travel insurance, payment of excess baggage, drinks, laundry service, communication (calls, faxes, emails, etc), domestic and international airport taxes, tips, or any other services and fees not specified in the itinerary.
Services not used
Some services may be interrupted or cancelled due to weather conditions, force majeure such as natural disasters, social unrest, strikes, etc, or other events beyond the control of the hotels, airlines other suppliers. No refund can be given for such interruptions or cancellations that are out of our control. PERU AGENCY will assist the passenger in every moment and modify the itinerary to their benefit, whilst providing constant assistance.
Exemption from the hotel sales tax for non-residents
Foreign visitors (not resident in Peru) are exempt from the 18% IGV (“Impuesto General a las Ventas” or general sales tax) on accommodation and meals in hotels. Our quotes already take this into account.
The only documents valid to receive the discount are your PASSPORT which should show the entry stamp into Peru with a date no more than 60 days before the date of entry into the hotel and during your stay in the hotel.
Insurance
We recommend that passengers buy insurance against cancellation of the trip, repatriation, and international medical insurance to cover any problem that may occur during the trip. We also suggest consulting your doctor and seeking advice about vaccinations and checking any medical condition when embarking on international trips.
Flight tickets
Full payment must be received in order to issue tickets. Fares are subject to availability and the final price can only be guaranteed with the purchase of the ticket. Refunds permitted and unpermitted changes and penalties that may be applied are in accordance with the policies of the airline. Tickets are non-refundable and non-endorsable in the event of cancellation.
Train tickets
Full payment must be received in order to issue train tickets. Fares are subject to availability and the final price can only be guaranteed with the purchase of the ticket. Refunds permitted and unpermitted changes and penalties that may be applied are in accordance with the policies of the train companies.
Baggage responsibilities
PERU AGENCY recommends that all passengers come to Peru, Ecuador or Bolivia with their own travel insurance covering lost luggage. PERU AGENCY cannot be responsible for:
* Lost or delayed luggage on domestic or international flights
* Hand luggage or personal items
* Items left behind by passengers in hotels, vehicles, or places visited during the trip.
We recommend our passengers not to pack any valuable items in their check-in luggage on transfers or flights.
Booking conditions
All bookings must include the following passenger or group information:
a. Full name and surname
b. Nationality
c. Passport number or identity number
d. Date of birth
e. Sex
f. Dietary restrictions (allergies, intolerance to certain products, vegans, vegetarians, etc) if any. The consequences on the physical or medical condition of the passenger of omitting this information is the sole responsibility of the passenger.
g. Airline booking code in the event that the passenger has made the booking themselves or through another external company.
h. Foreign students should have a valid student card or under 18 years old. No other document will be accepted for discounts to the tourist attractions.
• Passport or ID number is MANDATORY in order to issue train, bus, or flight tickets.
• Travellers should have a valid passport to enter our country. Your passport should be valid for at least 6 months from the date of entry into Peru.
Definition of group size
INDIVIDUALS or FITS: Up to 7 passengers (however, PERU AGENCY can provide rates for groups depending on the number of people and the excursions wanted)
GROUP: 8 or more (the 9th passenger is free)
Payment conditions
PERU AGENCY requires full payment:
– 30 days before the arrival of individual passengers / FITs
– 45 days before arrival for groups. Payment periods for groups may vary according to the policy of the hotels. Please ask.
Payment implies the acceptance of the terms and conditions laid out in this document; also those indicated in the quote or booking confirmation.

All transfer costs are assumed by the sender and should have the number or name of the PERU AGENCY tour as reference. In addition, we ask you to send us a copy of the payment confirmation with the following information:

This information is key to us being able to track the payment.

You can pay by credit card via the internet.
C. Alternative means of payment
We accept Western Union or Money Gram transfers. If you wish to pay by this method please inform our sales executive and we will provide you with the necessary information.
Cancellations and refunds
Requests for cancellations and requirements for refunds should be submitted in writing and include all relevant information. You will receive a reply from us as soon as we have consulted with the providers of the service, indicating the respective cancellation charges. The request will be processed on working days.
Cancellation charges
Different cancellation charges apply to different hotels and service providers. The cancellation costs tend to increase the closer you are to the arrival date. PERU AGENCY will make every effort to ensure these costs are as low as possible.
Policy for children
Discounts entry to tourist attractions applies only for children under 8 years old.
Discounts in hotels apply for children under 5 years old sharing a bed with their parents; in other words where no extra bed has been requested. Only one child per room with two people is allowed. An additional charge for breakfast may apply depending on the policy of the hotel.

Special dates
Some services increase their rates during bank holidays or special dates in Peru:
* Holy Week
* Inti Raymi (23 to 27 June, only in Cusco)
* Christmas (December 24 and 25)
* New Year (December 31st and January 1st)
Extra costs may also apply in the event of special events, congresses, forums, or international summits in our country.
Special Travellers terms & conditions for the Inca Trail Tour Packages
In accordance with Resolution #002-2004-UGM-CD, published by El Peruano on 2nd Nov 2004 and modifying chapter III of the Regulation of the Inca Trail, bookings are guaranteed by governmental institutions only by providing complete name, nationality and passport numbers of the passengers, and having paid in full for the entry fees and staff (cook and team of porters). 100% NON-REFUNDABLE.
1. The booking should first have been confirmed by email by our Sales and Reservations Department, confirming availability for the dates requested.
2. Full details of passengers must be provided and the required deposit sent (Non-Refundable, Change of Name, Date, etc. Not Permitted)
3. You must send a copy of your current passport to avoid problems.
4. For the 2 days Inca Trail we accept bookings with a minimum of 2 people in shared service. Single passengers should contact our sales team.
** Since entry is limited to 500 people per day (including passengers and agency staff), we recommend making your reservation as soon as you can to ensure availability on the dates required.
** Very Important: The following passenger information is mandatory in order to make a reservation for the Inca Trail:
a. Complete name and surname

c. Copy of passport
d. Date of birth

f. Dietary requirements
The exact information provided by you will be checked by the government body responsible for regulating the access to the Inca Trail and will appear on the official permit to enter on the requested date. This should also include any change to the above-mentioned details (for example, new passport number). We kindly request you inform us by email as soon as possible. The government reserves the right to refuse entry to any visitor whose details do not match those on the official permit.
PERU AGENCY is not responsible for refused entry in the event that the passenger information changed without us being previously informed.
Travellers Terms & conditions for other adventure tours
– The tour will be carried out according to the policy of each excursion indicated in the adventure rates and manual.
– PERU AGENCY is not responsible for accidents. We will provide all support and assistance necessary to evacuate and deal with the passenger. All extra costs generated by any accident or eventuality whilst trekking will be covered by the passenger.
– To make a reservation we require:

You must be in good physical condition for trekking. Any consequences generated by the omission of information regarding physical, medical, or other conditions are the sole responsibility of the passenger.
Responsibility clause:
PERU AGENCY, will not be held responsible for any injury, death, loss, delay, trouble, or damage to personal items in the provision of any goods or services due to force majeure: illness, government restrictions, acts of civil war, insurrection, or rebellion, strikes or other activities, any kind of terrorists or criminals, food poisoning, mechanical failure of an airplane or any other method of transport or for delays in leaving or arriving on time.
PERU AGENCY is not responsible for the error or omission of any provider (eg accommodation or transport companies) if the client makes their own booking directly with another service provider that is not PERU AGENCY. We will provide any necessary support within our power.
PERU AGENCY reserves the right to photographs or videos of their trips, and the use of these for advertising or commercial use.
